The Düsseldorf Higher Regional Court has clarified that the allocation of charging infrastructure at Tank & Rast motorway service stations without a tender process was unlawful. This is good news for competition. This ruling paves the way for the transparent, non-discriminatory and competitive allocation of space for charging infrastructure. This is the only way to ensure fair conditions for different providers, as well as greater choice and lower charging prices for consumers. We therefore advocate, as a matter of principle, that the competitive allocation of space for charging points should become the norm – including outside motorways.
