Effective competition requires that competition law rules are consistently applied and further developed. The Monopolies Commission is therefore legally mandated to review and assess antitrust decision-making practice in Germany – a mandate it has fulfilled since its establishment in 1974. Every two years, it analyses developments in German competition law in its main report, taking the European level into account as well, since decisions by the European Commission and the European Court of Justice have a significant impact on the national competition framework. This remit is based on the Act against Restraints of Competition (GWB). In addition, the Monopolkommission addresses competition law issues in special reports, policy briefs and current statements.
