Special Report 63

The report analyses the planned amendment to the Act against Restraints of Competition (GWB). In it, the Commission examines provisions on legal succession under antitrust law and rejects an extension of the special abuse supervision regime for energy markets. Overall, the Monopolies Commission views large parts of the planned GWB amendment favourably, but sees an urgent need for improvements on key points, including in relation to health insurance funds and the drinking water supply. 

However, the draft does not propose any solutions to pressing competition law issues, such as the question of whether the GWB applies to statutory health insurance funds or to water charges.
