In November 2006, the Federal Ministry for Economic Affairs published a draft bill to combat price abuse in the energy supply and food retail sectors. The draft bill focuses, on the one hand, on tightening controls on abusive practices in the energy sector. Secondly, the ban on selling below cost in the food sector is to be made stricter than at present. Furthermore, there are plans to abolish the suspensive effect of appeals in abuse proceedings, thereby bringing the legislation into line with European law. In addition, a number of minor amendments are proposed, most of which are purely editorial in nature. In this special report, the Monopolies Commission sets out its views on the reform plans of the Federal Ministry for Economic Affairs.
