Regulations governing access to the skilled trades – in particular the requirement to hold a master craftsman’s certificate – have a direct impact on competition: they can create barriers to market entry, restrict competition and affect the freedom to choose one’s profession. The Monopolies Commission monitors the competitive framework in the skilled trades on its own initiative and issues ad hoc statements on the basis of Section 44(1), fourth sentence, of the Act against Restraints of Competition (GWB). In doing so, it analyses whether existing regulations are designed in a manner consistent with competition and formulates evidence-based recommendations for policy-makers and legislators. The Monopolies Commission publishes its assessments in special reports, policy briefs and other statements.
