The media industry is a complex sector with specific competition policy issues: market concentration, state regulation and sector-specific rules shape competition in various sub-markets. The Monopolies Commission monitors these developments on its own initiative and, on the basis of Section 44(1), fourth sentence, of the Act against Restraints of Competition (GWB), issues statements as and when required – for example, on the marketing of media rights in sport, on fixed book prices, and on competition issues in the broadcasting sector. In doing so, it analyses whether existing regulations and market structures are compatible with the principles of effective competition and formulates evidence-based recommendations for policymakers, legislators and regulatory authorities. The Monopolkommission publishes its assessments in special reports, policy briefs and other statements.
